OUT-OF-OFFICE: 24-7 ACCESSIBILITY MAY MEAN OVERTIME LIABILITY

In the age of 24/7 accessibility, the use of mobile devices to stay “connected” outside of regular business hours has become increasingly common. After-hours accessibility may come at a big cost to employers if they find themselves faced with overtime violations for failing to properly track and compensate employees for all of their “work away from work.”
In this joint seminar, CGWG Attorney Missy McJunkins Duke will explain changes the much-anticipated DOL Overtime Rule will bring to employers, including a drastic increase in the minimum salary threshold for executive, administrative, and professional employee exemptions and the issue of whether and how to pay employees for time spent working after-hours. Ted Clouser, Vice President of PC Assistance, will discuss certain precautions for allowing employees to use their smartphones for emails outside of working hours and the necessity for remote access for nonexempt employees.
In order to prevent overtime liability, now is the time to review employment practices, employee policies and overtime protocol so your business will be prepared before the final rule takes effect on December 1, 2016.
